The law of foreigners is the legal system for people who live in a different country where they are not citizens. The law of foreigners is a branch of law which regulates rights and obligations that foreigners are subject to in the Republic of Turkey.
It includes regulations such as giving a residence permit or a work permit to a foreigner, deportation and marriage of foreigners. The laws to be enforced in such cases are in the Article 2 of the International Private and Procedure Law.
According to this Article;
‘’ The judge shall apply the rules of the Turkish conflict of laws and the governing foreign law which is applicable in accordance with the said rules ex officio. The judge may seek assistance of the parties for the determination of the content of the governing foreign law.
If the applicable foreign law provisions cannot be ascertained despite all efforts, Turkish law shall be applied.’’
